The Congress of internationalization and foreign trade in Aragón
During the next 26th and 27th of September Navarro Llima Abogados S.L. will take part in the VIII International Meeting Arex, “the event” of reference about international trade in Aragón – promoted by Aragon Exterior. In this event our partner Jaime J. Navarro will give the Conference “Resolution of international trade disputes” where we will analyze the most common situations and propose the best advice to deal with operations of International trade in the best possible way.
We will analyze the usual trade disputes and the preventive measures we can take to avoid them.
We call commercial conflict to any situation that occurs within a business relationship in which one part manifests lack of conformity to another part of the relationship. Obviously the cases are enormous, and can occur within a trading operation, agency, distribution, etc. But we must differentiate these conflicts from a mere lack or delay of the payment. Sometimes a delayed or incorrect payment is confused with a commercial conflict and vice versa.
If the commercial conflict occurs in an international relationship multitude of factors must be analyzed, not only the causes, responsibility for the lack of conformity and the possible commercial interest, which would be common with a national conflict, but also the applicable law, the competent jurisdiction and the potential result of an unfriendly or unnegotiated solution.
Only considering all these factors at the start of the business relationship we can avoid unwanted situations.
