And this is where the theory of homogeneity comes into play, which, in short, states that a defendant CAN be convicted of a crime for which he was not charged<\/strong>, provided that this second crime shares a series of common and fundamental characteristics with the crime for which the accusation was filed, such that the accused, through his allegations and submission of evidence regarding the initial crime, would have been guaranteed his right to defense regarding the second crime.<\/p>\n

The accusatory principle is closely linked to the rights to effective judicial protection and the right to be informed of the accusation and to a trial with full guarantees. Together, this principle derives from the right of every defendant in criminal proceedings to promptly know the accusation against him. This accusation is evidently based on the commission of specific acts, but also on their legal classification, that is, the applicable crime.<\/p>\n

Therefore, it is not possible, for example, to convict for misappropriation if the charge was for theft.<\/p>\n
